Terms of Service
Last updated June 22, 2026. Bookings, payments, cancellations, insurance, arbitration — written in plain English with statutory carve-outs preserved.
1. Acceptance of Terms
By accessing or using the PickRV platform ('Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not use the Service.
PickRV reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 30 days before taking effect. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
These Terms constitute the entire agreement between you and PICKRV LLC regarding your use of the Service and supersede any prior agreements.
2. Eligibility & Account Requirements
Renters must be at least 25 years old to rent an RV or houseboat through PickRV. You must hold a valid, unrestricted driver's license issued in the United States or Canada. International licenses must be accompanied by an International Driving Permit (IDP). All renters must meet the minimum insurance requirements set by the vehicle owner and PickRV.
Hosts must be at least 18 years old and legally authorized to rent their vehicle. Hosts must provide proof of vehicle ownership or authorized agency, valid commercial RV rental insurance meeting the carrier-specified minimums disclosed during onboarding, and a clean vehicle title without salvage or flood history.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify PickRV immediately of any unauthorized use of your account.
3. Bookings, Payments & Fees
All bookings are subject to host availability and acceptance. Instant Book listings are confirmed immediately upon payment. Standard listings require host approval within 24 hours; if the host does not respond, the booking request expires and no charges are applied.
Payments are processed securely through Stripe, our PCI DSS Level 1 certified payment processor. The full trip total is due at booking through Stripe Checkout. For Instant Book listings and bookings of $500 or more, your card is authorized at booking and the charge is captured approximately 72 hours before the trip start; all other bookings are charged when you confirm payment. Security deposits, where required, are a separate card authorization placed shortly before pickup — never an extra charge unless a damage claim is filed.
Hosts set the base price they wish to receive. PickRV charges hosts a 15% commission, which is added as a markup on top of the host's base price and built into the listed price the renter sees; it is PickRV's revenue. Renters pay a transparent 10% service fee, shown at checkout on the rental subtotal, plus applicable state and local tax. There is no protection reserve. The final renter price is shown at checkout. Any future change to renter-side fees will be disclosed on the listing page and in the booking summary BEFORE payment, in accordance with 16 CFR Part 464 (FTC Junk Fee Rule). Security deposits, where required by the host, are held separately and released after the 48-hour post-trip review window if no damage claim is filed.
4. Cancellation & Refund Policy
Every booking carries PickRV's platform refund floor, which no host policy may reduce: a 100% refund (free cancellation) when you cancel at least 48 hours before pickup; a 50% refund of the base rate when you cancel between 24 and 48 hours before pickup, with cleaning fees and optional add-ons refunded in full; and no refund inside 24 hours of pickup, though the booking may be transferred to a qualified alternate driver at no fee.
Hosts select a cancellation tier, clearly displayed on every listing: Flexible ("Free cancel up to 24h. Half refund even same-day."), Moderate, the default ("Free cancel up to 48h. Half refund 24–48h."), or Strict ("Free cancel up to 7 days. Reserved for premium / seasonal rigs above $400/night."). A tier may make cancellation terms more generous for the renter than the platform floor, never stricter — where a tier schedule is stricter at any band, the floor prevails. The exact refund schedule for your booking is resolved at checkout from the host's tier, the platform floor, and any state consumer-protection overlay; it is shown before you pay and frozen onto your booking confirmation.
Host-initiated cancellations result in a 100% refund to the renter plus a $50 rebooking credit. Hosts who cancel confirmed bookings may face penalties including reduced search ranking, superhost status revocation, and account suspension for repeated cancellations.
Weather-related cancellations due to named storms, NWS warnings, or mandatory evacuation orders qualify for a 100% refund regardless of the host's tier; for boat rentals, an active NWS Small Craft Advisory or higher during the trip window triggers the same full refund. PickRV reserves the right to issue full refunds in extraordinary circumstances at its discretion.
5. Insurance & Liability
PickRV is NOT an insurer. PickRV is a technology platform connecting renters with hosts; PickRV does not solicit, place, underwrite, or administer insurance. At checkout, renters may opt in to a policy issued and administered by a licensed third-party insurance carrier (carrier name, NAIC number, and product details are disclosed on the checkout page before payment). Hosts are required to maintain their own valid commercial RV insurance as a condition of listing on PickRV; verification of host coverage does NOT extend coverage to renters.
PickRV is not liable for personal injury, property damage, or financial loss beyond the limits imposed under applicable law. Renters are encouraged to review carrier coverage details on the checkout page, contact the carrier directly with policy questions, and carry personal insurance as supplementary protection.
Security deposits are determined by the host (typically $500-$2,500) and are applied toward damage claims. Damage disputes follow PickRV's structured resolution process: photographic evidence is reviewed, both parties submit statements, and PickRV's Trust & Safety team renders a decision within 30 days.
6. Host Responsibilities & Standards
Hosts must maintain their vehicles in safe, roadworthy condition and comply with all applicable federal, state, and local laws and regulations. Vehicles must be certified by the host against PickRV's 50-point checklist, including mechanical systems, safety equipment, propane systems, electrical systems, and cleanliness standards.
Hosts must accurately represent their vehicles in listings, including truthful descriptions of features, sleeping capacity, mileage limitations, and any known defects or limitations. Misrepresentation may result in listing removal, refund obligations, and account suspension.
Hosts must respond to booking requests within 24 hours and maintain an acceptance rate of at least 80%. Hosts must provide clear check-in/check-out instructions, ensure the vehicle is clean and fully fueled, and be available for contact during the rental period.
7. Prohibited Conduct
Users may not: (a) use the Service for any illegal purpose; (b) misrepresent their identity or qualifications; (c) circumvent the PickRV payment system, including soliciting or accepting off-platform payments; (d) sublease, re-rent, or use rented vehicles for commercial purposes without prior authorization; (e) exceed stated mileage limits or use vehicles outside approved geographic areas; (f) engage in fraudulent activity, including fake reviews, shill bookings, or insurance fraud.
Hosts may not: (a) discriminate against renters based on race, color, religion, sex, national origin, disability, or any other protected characteristic; (b) impose hidden fees or charges not disclosed in the listing; (c) require renters to sign supplementary agreements that conflict with these Terms; (d) share renter personal information with unauthorized third parties.
Violations of prohibited conduct may result in immediate account termination, forfeiture of pending payouts, legal action, and referral to law enforcement where appropriate.
8. Intellectual Property & Content
All content, trademarks, logos, designs, and intellectual property on the PickRV platform are owned by PICKRV LLC (or, post-formation, the successor legal entity that operates the PickRV brand) and protected by US and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from PickRV content without express written permission.
Users retain ownership of content they submit (photos, reviews, descriptions) but grant PickRV a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, distribute, and display such content for platform operations, marketing, and promotional purposes.
Users are solely responsible for content they submit and warrant that they have all necessary rights and permissions. PickRV reserves the right to remove any content that violates these Terms, community guidelines, or applicable law.
9. Dispute Resolution & Arbitration
Disputes between users should first be addressed through PickRV's Resolution Center within the platform. PickRV's Trust & Safety team will review evidence, facilitate communication, and render a decision within 30 days for damage claims and within 14 days for service disputes. Either party may also bring a qualifying claim in a court of small-claims jurisdiction (claims under $10,000) in lieu of arbitration.
If a dispute cannot be resolved through the Resolution Center or small claims, it shall be settled through binding arbitration administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules then in effect, including the AAA Mass Arbitration Supplementary Rules where applicable. Arbitration proceedings may be conducted by telephone, video conference, written submissions, or in person in the county of the consumer's residence at the consumer's election. Where the AAA Consumer Rules require PickRV to advance filing, administrative, and arbitrator fees, PickRV will do so. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) governs the interpretation and enforcement of this section.
CARVE-OUT FOR PUBLIC INJUNCTIVE RELIEF (per McGill v. Citibank, N.A., 2 Cal.5th 945 (2017)): Nothing in this section shall preclude any party from seeking public injunctive relief in a court of competent jurisdiction. If a court determines that a claim for public injunctive relief may not be arbitrated, that claim — and only that claim — shall be severed and litigated in court; the remainder of this arbitration agreement remains enforceable.
CLASS ACTION WAIVER (with limited severability): To the maximum extent permitted by applicable law, you and PickRV each waive the right to bring or participate in a class, consolidated, or representative action against the other in arbitration or in court. If a court of competent jurisdiction determines that this waiver is unenforceable as to any particular claim, that claim shall proceed in court while the remaining claims are arbitrated on an individual basis. This severability rule does not apply to public-injunctive-relief claims, which are addressed in the carve-out above.
MASS-ARBITRATION PROTOCOL: Where 25 or more substantially similar individual demands are filed against PickRV within a 60-day window, the parties agree to follow the AAA Mass Arbitration Supplementary Rules, including bellwether arbitration of an initial set of cases and a mediation phase before further filings proceed.
10. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKRV'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID BY YOU TO PICKRV IN THE 12 MONTHS PRECEDING THE CLAIM, (B) $500, OR (C) THE AMOUNT OF INSURANCE PROCEEDS ACTUALLY RECOVERED ON YOUR BEHALF FROM A CARRIER IN CONNECTION WITH THE CLAIM.
CARVE-OUTS (this limitation does NOT apply to): (i) bodily injury, death, or personal injury; (ii) gross negligence, willful misconduct, fraud, or intentional misrepresentation; (iii) violations of applicable consumer protection statutes, including but not limited to the California Consumers Legal Remedies Act (Cal. Civ. Code § 1770), the California Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.), the California False Advertising Law (Cal. Bus. & Prof. Code § 17500 et seq.), the federal Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.), and analogous statutes in other jurisdictions; (iv) PickRV's indemnification obligations expressly set forth in these Terms; (v) PickRV's infringement of intellectual property rights; or (vi) any other category of damages that applicable law prohibits from being limited. This list is intended to comply with California Civil Code § 1668 and similar laws, and shall be construed to preserve the maximum coverage permitted by law.
EXCEPT IN THE CARVE-OUT CATEGORIES ABOVE, PICKRV IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless PICKRV LLC (and, post-formation, the successor legal entity that operates the PickRV brand), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights — EXCEPT to the extent caused by PickRV's own gross negligence, willful misconduct, or violation of statute.
11. Governing Law & Severability
These Terms are governed by and construed in accordance with the laws of the State of Florida, where PICKRV LLC is registered, without regard to its conflict-of-laws provisions — except that the mandatory consumer-protection laws of the state where you reside or where the rental occurs continue to apply to the extent they give you greater protection. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Broward County, Florida.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
12. Reviews, Ratings & Review Integrity
Only verified renters who completed a paid booking may submit a star rating + written review for a host or vehicle. Hosts may rate renters under the same constraint. Both parties have 14 days from trip end to submit; reviews publish simultaneously after both submit or once the 14-day window closes (whichever comes first).
PickRV does not accept paid reviews, fabricated reviews, or reviews submitted in exchange for fee waivers, account credits, or other consideration. Attempting to solicit, post, or coordinate fake reviews is grounds for immediate account termination and may be referred to law enforcement under 15 U.S.C. §45 (FTC Act §5) and 16 CFR Part 465 (FTC Rule on the Use of Consumer Reviews and Testimonials).
Reviews may be edited within 48 hours of publication to correct factual errors. PickRV reserves the right to remove reviews that contain personally identifying information, threats, harassment, off-topic content, or content that violates the Community Guidelines. Removal decisions are made by the Trust & Safety team and may be appealed via support@pickrv.com.
Aggregate ratings published on listing pages reflect only verified-booking reviews; PickRV does not synthesize, simulate, or seed ratings on listings that have no completed bookings. Listings without a completed booking display an honest 'No reviews yet' state rather than a placeholder rating.
