RV hazmat: propane, gasoline, lithium batteries, tunnels: the short answer
PHMSA regulates hazardous materials transport. Personal-use RV propane (up to 30 lbs per cylinder) is exempt for road transport. Tunnel restrictions, lithium battery transport, and gasoline-can carriage have specific rules.
- Propane cylinder transport: 49 CFR 171.1(d)(6) places transport of a hazardous material by an individual for non-commercial purposes in a private, leased or rented vehicle outside the Hazardous Materials Regulations entirely — not merely outside the placarding rule.
- Tunnel restrictions: Port Authority Traffic Rules 2.2(c) bar vehicles equipped with liquefied petroleum gas installations, RVs included, from the Holland Tunnel, the Lincoln Tunnel and the George Washington Bridge lower level. There is no materials-of-trade exemption and emptying the tanks does not lift the ban.
- Gasoline can transport: Carrying gasoline in approved DOT cans (typically up to 5-gallon, properly secured) is permitted for personal use.
- Lithium house batteries: a battery installed in an RV you drive for personal, non-commercial use sits outside the Hazardous Materials Regulations entirely under 49 CFR 171.1(d)(6), whatever its size. The Watt-hour limits govern shipping cells and batteries, not your house bank.

1. Propane cylinder transport
The rule: Under 49 CFR 171.1(d)(6) the federal Hazardous Materials Regulations do not apply to transportation of a hazardous material by an individual for non-commercial purposes in a private motor vehicle, including a leased or rented motor vehicle — personal-use propane in a rented RV falls outside the HMR entirely, placarding included. PHMSA sets no cylinder-orientation or valve-position requirement for it; where the HMR do apply, to commercial carriage, 49 CFR 177.840(a)(1) permits cylinders to be restrained in an upright or horizontal position. Closing valves before driving is a safety practice and a condition set by particular tunnel, bridge and ferry authorities, not a federal rule.
What it means in practice: Close all propane valves before driving. Some tunnels prohibit propane-equipped RVs entirely.
- Specific federal land unit may have a superintendent's compendium that adds local restrictions.
- Tribal land adjacent to federal land operates under tribal jurisdiction — not federal.
2. Tunnel restrictions
The rule: Port Authority Traffic Rules §2.2(c) bars vehicles equipped with Liquefied Petroleum Gas installations, RVs included, from the Holland Tunnel, the Lincoln Tunnel and the George Washington Bridge lower level, and there is no materials-of-trade exemption for propane — emptying the tanks does not help, so route over the GWB upper level. The Hampton Roads Bridge-Tunnel is not a ban: 24VAC30-61-20 lists it among Virginia's four urban tunnels and 24VAC30-61-40 classifies 2.1 Flammable Gas there as RESTRICTED rather than prohibited, allowed in non-bulk containers, with VDOT requiring motor homes to stop and have propane tanks checked before going through.
What it means in practice: Plan routes around tunnel exclusions; verify with each tunnel authority before transit.
- Specific federal land unit may have a superintendent's compendium that adds local restrictions.
- Tribal land adjacent to federal land operates under tribal jurisdiction — not federal.
3. Gasoline can transport
The rule: Carrying gasoline in approved DOT cans (typically up to 5-gallon, properly secured) is permitted for personal use.
What it means in practice: Spare gas is fine for generator refills; spilling on the highway can result in EPA + state cleanup costs.
- Specific federal land unit may have a superintendent's compendium that adds local restrictions.
- Tribal land adjacent to federal land operates under tribal jurisdiction — not federal.
4. Lithium house batteries
The rule: A house battery installed in an RV you are driving for personal, non-commercial use sits outside the Hazardous Materials Regulations entirely under 49 CFR 171.1(d)(6), whatever its size. The Watt-hour limits — 20 Wh for a lithium ion cell and 100 Wh for a lithium ion battery, at 49 CFR 173.185(c)(1)(i) — apply to batteries offered for shipment, and meeting them is an exception from certain requirements, not a blanket exemption: packaging, state-of-charge, marking and quantity conditions still attach. Almost no RV house battery meets them. A 12.8 V, 100 Ah LiFePO4 bank is about 1,280 Wh, roughly 13 times the 100 Wh limit, and LiFePO4 is a lithium ion chemistry, so shipped in commerce it is regulated as UN3480 / UN3481 Class 9.
What it means in practice: RV lithium upgrades are PHMSA-compliant; transporting separately by air is different.
- Specific federal land unit may have a superintendent's compendium that adds local restrictions.
- Tribal land adjacent to federal land operates under tribal jurisdiction — not federal.
Enforcement reality
Federal enforcement of these rules happens at federal-land entry stations (NPS gates, BLM patrols, USFS rangers, USACE locks), at international borders (CBP processing), and via federal court for serious violations of statute. Day-to-day enforcement is typically courteous and educational on first contact; repeat violators or commercial-scale violations escalate quickly. Federal officers carry their own statutory citation authority distinct from local police; a federal citation cannot be 'fixed' through state court channels. Routine encounters at NPS visitor centers, BLM field offices, and USFS ranger districts are educational opportunities — officers prefer to issue warnings + correct conduct, especially when the visitor demonstrates good faith.
Typical fines: Federal misdemeanors typically $100-5,000 per violation; serious violations escalate to federal felony with possible imprisonment. Civil compromise of forfeiture (vehicle, equipment, wildlife) can stack on top of the criminal penalty.
- Federal violations may be reported to your home-state DMV via Driver License Compact for traffic-adjacent infractions.
- Civil + criminal penalties stack for repeated or willful violations.
- Federal land-management agencies maintain visitor-history records that affect future permit eligibility.
- A federal misdemeanor conviction may affect employment, security clearances, and firearm rights in some contexts.
Foreign visitor notes
Foreign visitors are subject to federal law identically to US citizens. Bring a valid passport, your home-country driver license, and an International Driving Permit (IDP) issued in your home country before arrival. The rental vendor's onboard documentation typically satisfies state-level operator competency, but federal officers can request your federal-immigration status documents (passport + I-94) at any federal land unit.
Border crossings into the US (from Canada or Mexico) require CBP declaration of every person, every item, and every vehicle. Cannabis cannot cross either border legally regardless of state or province legalization. Firearms require pre-clearance both directions. Bear spray, certain food products, and some plants are restricted.
Foreign visitors should also be aware that federal-land rules apply identically regardless of language proficiency. Major NPS visitor centers offer multilingual handouts (typically Spanish, French, German, Japanese, Mandarin) but interior trail signage is English-only at most units. Download the official park map in your preferred language before arrival.

Tribal sovereignty
Federal land managed by BLM, USFS, NPS is distinct from tribal land. Tribal land operates under tribal sovereignty and the relevant tribal nation's own statutes — not federal land-management rules. Federal regulations do not automatically extend to tribal land; tribal regulations do not extend to federal land. Verify per-tribe rules separately, ideally with the tribal natural-resource office. Travel that involves a tribal land permit (Navajo Nation, Hopi, Pueblo nations, Wind River, etc.) is administered entirely by the tribe.
Lgbtq trans license
Travelers whose driver license name or gender marker does not match current presentation should carry passport (federal ID) alongside the state license. Federal land officers generally follow federal anti-discrimination guidance; state and county officers vary. For travel safety, document your federal-level identity proof carefully and know the closest federal court if a state-level interaction escalates.
Foreign visitor
Federal law applies identically to foreign visitors. There is no separate 'tourist exception' for federal regulations. Foreign visitors carry the same compliance obligations as US citizens for cannabis prohibition on federal land, firearms transport rules, wildlife transport, and border-crossing declarations. Language barriers are not a defense; bring an English-speaking traveling companion or a translation app to any federal-land interaction if your English is limited.
What Multi-agency federal doesn't tell you
What official federal pages typically do NOT publish in a single place: the practical interplay between federal rules and state law. A renter who reads only the state DMV page does not learn that federal rules override the state's cannabis legalization on federal land. A renter who reads only the federal page does not learn that the state's stricter inspection rule applies on top. The official content is technically correct in each silo but creates a false sense of complete information.
Federal regulations also rarely surface the rental-contract dimension. The rental vendor's contract terms layer ON TOP of federal + state law. All three apply simultaneously to a given booking. A vendor can prohibit conduct that federal law permits (e.g., off-pavement driving) and the contract controls between renter and vendor regardless of what the federal page says.
Finally, federal pages rarely surface the day-to-day enforcement reality. The statute says X is prohibited; the field officer issues warnings vs citations vs arrests based on context, demeanor, and the operational impact. Renters who understand this can navigate gray areas with significantly more confidence than the bare statute would suggest.
- Federal supremacy: Federal law preempts conflicting state law on federal land — including cannabis legality, firearm rules, drone operation.source
- State law layer: State law applies on state land + roads + most private property within the state; vendor contract layers on top.source
- Tribal sovereignty: Tribal land operates under tribal jurisdiction — neither state nor federal land-management rules automatically apply.source
- Vendor contract control: Rental vendor's contract terms can be stricter than statute; they control between the parties.source
